1) Who is the Data Controller responsible for processing your data?

The data controller is whoever decides the purpose that your personal data is used for, and in this case it is HOOT AUDIO, S.L., with Company Tax ID B67518068 and registered address at Avda. Diagonal, 682, 10º planta, 08034, Barcelona.

2) What data do we process?

We collect and process the following information about you: 

  • Identifying data provided when creating your HOOT user account. You provide us with information when you register on the Platform, namely your name and email address.
    If you choose to register to use the Platform using your social media account details (e.g. Facebook, Twitter, Instagram or Google), you will allow your social media account to provide us with your username and public profile. The shared information will therefore depend on the settings you have determined in your profile.
  • Data regarding your list of contacts. You can choose to search other users of the Platform using the “Search Friends” feature, which will allow you to see how many people in your device’s contact list or the list of friends on other social media accounts are using the App and give you the option to follow them. 
  • Information related to your use of the App. Content generated on the Platform, including preferences that you establish, uploaded content (photographs, videos, voice), comments you make, contacts, videos viewed, interests, preferences, etc. 
  • Information regarding your browsing. IP address, browsing history, information about the device you are using, operating system, network type, your screen resolution, the version of the application you are using, etc.
    When you log in from multiple devices, we can use your profile information to identify your activity on all devices.
  • Location. For the Platform to function  correctly it will be necessary to use information regarding your location. If you do not wish to share this, you can disable location services through your mobile device settings. However, in that case, the App will not be able to offer functionality tailored to your location.

3) For what purpose do we process personal data and what is the legitimate basis?

The collection and processing of personal data shall be carried out, depending on the relationship with the User, in accordance with the following purposes: 

  • The personal data provided throughout the business relationship shall be processed for the purpose of properly managing this relationship, which includes the creation and management of your user account, contact relationships, sending informative communications about the service or about any change in it, as well as commercial communications about products or services similar to the one contracted. We may also contact you to find out your level of satisfaction with the service and conduct surveys. In this case, the legal basis for the processing of your data shall be the execution of the corresponding contract for the provision of services and the legitimate interest of the data controller in controlling the quality of its service.
  • In the event of queries or requests made through any of the channels provided for this purpose, the information will be used for the purpose of attending to your query in accordance with its nature, which includes the possibility of contacting you and forwarding it, if necessary, to the department that may be of assistance. The legal basis, in this case, for the processing of your data will be the consent given in the contact form and/or the legitimate interest of the data controller.
  • In some cases, your contact information may be used for the submission of electronic commercial communications about products, services, promotions, news, competitions and other content of HOOT, and to provide you with personalised advertising and services based on your geographic location. The legal basis, in this case, for the processing of your data will be your consent given in the corresponding form.
  • Data concerning your tastes, interests and preferences will be processed for the purpose of anonymous profiling as well as for analysing or predicting your interests, behaviour and other attributes. 
  • Furthermore, users’ browsing data and cookies will be processed for the purpose of improving accessibility, personalising and analysing your browsing, as well as showing advertising and announcements based on your interests in accordance with our Cookie Policy. The lawful basis that allows us to process your data for this particular purpose is your consent given by accepting cookies.

4) Do we process the data of minors?

The Platform is suitable for all age groups. However, in order to register, you must be over the age of 18. 

The User, by registering on the Platform, responsibly states and guarantees that he/she is over the age of 18. HOOT cannot verify the accuracy of the data provided, nor will it be responsible for those who are under the age of 18 and access the Platform and/or HOOT’s Contents without complying with the said condition of access. 

However, in the event that we become aware that a person under the required age has registered as a User, the account shall be cancelled as soon as possible. Any User who is aware of this situation is requested to inform us by sending an email to the following address: info@hoot-audio.com.

HOOT recommends that parents, representatives or legal guardians supervise or take appropriate precautions while minors are browsing the Internet, and establish filters on the information and content to which minors may or may not have access.

5) Personal data of third parties

In the event that you provide data of third parties, you guarantee that you have their consent and undertake to pass on to them the information contained in this Policy, exempting HOOT from any responsibility in this regard. However, HOOT may carry out the appropriate checks to verify this, in accordance with data protection regulations.

6) What recipients will the data be communicated to?

The personal data collected may be shared with third party service providers who shall act as data processors for HOOT, such as suppliers of IT tools, analysis services, technical support, etc. 

Some of these suppliers may be outside the European Economic Area, so the use of their services may result in international data transfers. However, all suppliers located outside the EU have adequate guarantees to ensure a level of protection for their data equivalent to the European one (Privacy Shield Agreement, European Commission standard clauses, Binding Corporate Rules, etc.) as required by the regulations in force.

Likewise, the Platform offers the possibility of sharing, through the “NGOs” section, the Audiobooks created by the User with different Non-Governmental Organisations (NGOs) with the sole purpose of making them available to the children they help and thus promoting children’s reading. In the event that you as the User freely choose to use this option, the Platform will allow you to send the selected content through the chosen email provider. By making use of this possibility you will be sharing your personal data, specifically your voice, name and email address with the NGO that is the recipient of the Audiobook donation. 

Furthermore, personal data processed may be communicated to companies of the group in order to properly manage the economic activity of the company group. 

Finally, the data may be shared in those cases determined by the regulations in force with authorities, judges, courts and State Security Forces and Agencies.

7) How long is data stored?

HOOT will process personal data for as long as is strictly necessary in accordance with the purpose of processing. Once your data is no longer necessary, it will be kept duly blocked, without the possibility of being used except for the attention and clearing of legal responsibilities derived from its treatment and/or the relationship with the User.

8) What are your rights when you provide us with your personal data?

HOOT informs you that you can exercise the following data protection rights: 

  • Right to request access to personal data: first, you have the right to obtain confirmation about whether or not HOOT is processing personal data concerning you and, in that case, access such data.
  • Right of rectification, erasure and to be forgotten: You also have the right to request the rectification of inaccurate data or, if applicable, request its deletion when, amongst other reasons, the data is no longer necessary for the purposes that they were collected for.
  • Right to restriction of processing: in certain circumstances, you may also ask HOOT to restrict the processing of your data, in which case it will be kept only for the exercise or defence of claims. 
  • Right to data portability– You have the right to have HOOT send your data to another organisation as long as you request it.
  • Right of objection: in certain circumstances and for reasons related to your particular situation, you may object to the processing of your data. In that case, HOOT shall cease processing your data, except for legitimate reasons, or for the exercise or defence of possible claims.
    In particular, you have the right to object to the processing of your data and to restrict the scope of this practice, including:
  • The right to object to the processing of your data for direct marketing purposes. You can exercise this right using the “Unsubscribe” link in marketing communications. 
  • Right to Withdraw Consent: Since Hoot’s processing of your personal data is, on certain occasions, based on consent, you have the right to withdraw it whenever you wish and to terminate such processing. 
  • Right to not be subject to any automated individual decision: you have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects on you or significantly affects you in a similar way, unless it is necessary for the conclusion or performance of a contract between you and HOOT, which is authorised by Union or Member State law, or we have obtained your explicit consent.
